Iowa Man Gets 16 Years For Burning LGBTQ Flag; Gay Rights Group Says Excessive

A 30-year-old Iowa man has been sentenced to 16 years behind bars after tearing down a gay pride rainbow flag from the front of a church and burning it - a sentence one prominent gay rights group thinks is excessive.

Adolfo Martinez was found guilty of a felony hate crime and third-degree harassment after he ripped the flag off the front of the United Church of Christ in Ames, Iowa - before walking over to the Dangerous Curves Gentleman’s Club, where he was reportedly a regular.

Martinez received the maximum sentence due to his status as a habitual offender with two prior felonies. He told KCCI in June that he destroyed the flag because he despises homosexuality, according to the Washington Examiner.

It was an honor to do that. It was a blessing from the Lord,” said Martinez. “It is a judgment, and it is written to execute vengeance on the heathen and punishments upon the people,” he added. “I burned down their pride. Plain and simple.”

Martinez pleaded not guilty despite saying he had no plans to fight the charges and claiming, “I’m guilty. Guilty as charged.”

The senior minister at the United Church of Christ, Rev. Eileen Gebbie - who is gay, said “It doesn’t feel good. However, it’s not going to slow us down. We won’t change.”

She told the Des Moines Register that she’s happy Martinez was found guilty, though she told NBC that 16 years was excessive.

I often experienced Ames as not being as progressive as many people believe it is, and there still is a very large closeted queer community here,” Gebbie explained. “But 12 people that I don’t know, who have no investment in me or this congregation, said this man committed a crime, and it was crime born of bigotry and hatred.”

“Hate crimes against the LGBTQ community are a serious matter as they inflict distinct emotional harms on their victims, and strike fear into the communities they target,” Reyes told NBC News. “That said, true justice should always strive to be about rehabilitation, reconciliation, and healing communities. It is difficult to see how a 16-year prison sentence accomplishes any of those goals.”

“He is our neighbor, and I would be glad to know him and to welcome him here to this space,” as he approaches 50 years of age upon his release.

According to NBC News, the director of gay advocacy group One Iowa, Courtney Reyes, thinks that the sentence is excessive, and says that while her organization appreciates how quickly the incident was handled, the sentence was excessive.

  1. You can burn and desecrate the American flag with impunity - it’s described as Freedom of Speech. But burn a fag flag and get 16 years? What happened to Freedom of Speech and the lib favorite - the “Freedom” to Express Yourself?

    • Amazing how burning the American Flag is merely Freedom of Speech, but burning a LGBTQ flag is a hate crime. If this is now the standard, how is burning the American Flag NOT a hate crime, and if you are citizen doing it, not treason? Seems to me, the day the Supreme Court ruled that burning the US Flag is freedom of speech, they pretty much set a precedent in this matter. This should be expeditiously overturned by the SCOTUS, if not, a Presidential pardon should be in order.

  3. So many blind eyes today, especially as the lawmakers/laws side with sin. They wouldn’t know what sin was even if they read about it in the Book. It’s sad not just what they’re doing to this generation, but the condemnation they’re placing on the next generation. All for selfish, their personal pleasure, no matter the ‘error of their ways’.

    I wonder which ‘good book’ he was referring to? I was raised to believe God is the only judge. We mere mortals do not get to judge other people’s faith or the lack thereof.
    He may be a stupid bigot, but the judge who decided on 16 years should be sanctioned. What stupidity. Bigots are everywhere. Locking them up does nothing except require everyone else to pay for their crimes. Keeping prisons open and staffed isn’t cheap. There are murderers in the big cities that get less time. Obviously the judge is a screaming liberal closet case too.
    Sentencing bigots to community service around those they hate would be a better punishment. Having to rub shoulders with a different viewpoint might teach them some degree of tolerance.
    I find it funny that the guy evoked God and scripture, just before going into his favorite titty bar . . .

  7. According to the Bible, homosexuality is an abomination . Therefore how is it that a gay church isn’t one. These times are the most absurd and unbalanced that I as an AMERICAN have ever experienced. Judgement day hopefully will come soon and those who have sinned will have to attone for their actions

    • It really irks me when someone takes the opportunity to use their Bible to proliferate their hate or intolerance of those they do not like or understand.
      Much of the debate over same sex relationships or marriage or homosexuality in general centers on one’s belief of whether homosexuality is a sin. If homosexuality is a sin, and marriage is ordained by God to be between a man and a woman, then the faithful can be tolerant of a sin but they cannot support it.
      None of the major Abrahamic religions (Judaism, Christianity, or Islam) support homosexuality or gay marriage. The Judeo-Christian belief that homosexuality is a sin is based on the relatively few scriptures that can be found in the Old and New Testament of the Bible. Interpretation of the scripture varies between liberal and conservative scholars. For example many people interpret the word “sodomite” in scripture to mean homosexual rather than simply a resident of Sodom — even though there was no word for homosexual or homosexuality in Hebrew, Aramaic or Greek. And, one must remember much of the known scriptures were written for the era at the time, and also by authors decades and life-times away from the original stories and sermons.
      And, one must also consider that there are several examples of close relationships written about in biblical scriptures that allude to possible homosexual love and desires (the entire book of Psalms, story of Ruth). And one must also remember what we have today (in English) is an interpretation by the monk scribes enlisted by King James of England. They had an ignorant view of the world, and limited physical knowledge of mankind in general. They thought bathing would kill them. They literally ate rotten meat, by hanging fowl from the eves until it was ‘tender’, then the cooked it. They had a lot of superstitions, and Medical Science was evil. Many of the ancestors of modern medicine were put to death for trying to figure out how the body works.
      Then, there’s Paul’s message to the church at Corinth. Christians follow the New Testament, and are not bound to Levitican Law (Old Testament). Of course, Leviticus is there as a guide, and there is a lot more about human species maintenance than anything else. If modern-day Christians were to allow for things like divorce, and adultery; then they must allow for things like same sex relations. There certainly are more ‘laws’ on other (now) modern human conditions that are forbidden in Leviticus. And, most punishments are death. So before you throw your stone, make sure you have no guilt or sin. Only God can judge. “He who is without sin may throw the first stone.”
      We have come a long way since medieval times.
      If you are going to stake your opinion on gay marriage based on what the Bible says about homosexuality it would be a good idea to have read the scriptures, and understand where they come from. The is nowhere in scripture that dictates anything against discussion and opinion. That is where pure belief sets in.
      Here is a list of the twelve scriptures that allude to homosexuality that can be found in the Bible;
      1. Genesis 19:5: “And they called unto Lot, and said unto him, where are the men which came in to thee this night? Bring them out unto us, that we may know them.”
      2. Leviticus 18:22: ” Thou shalt not lie with mankind, as with womankind: it is abomination.”
      3. Leviticus 20:13: “If a man also lie with mankind, as he lieth with a woman, both of them have committed an abomination: they shall surely be put to death; their blood shall be upon them.”
      4. Deuteronomy 23:17: ” There shall be no whore of the daughters of Israel, nor a sodomite of the sons of Israel.”
      5. Judges 19:22: “Now as they were making their hearts merry, behold, the men of the city, certain sons of Belial, beset the house round about, and beat at the door, and spake to the master of the house, the old man, saying, Bring forth the man that came into thine house, that we may know him.”
      6. 1 Kings 14:24: “And there were also sodomites in the land: and they did according to all the abominations of the nations which the LORD cast out before the children of Israel.”
      7. 1 Kings 15:12: “And he took away the sodomites out of the land, and removed all the idols that his fathers had made.”
      8. 1 Kings 22:46: “And the remnant of the sodomites, which remained in the days of his father Asa, he took out of the land.”
      9. 2 Kings 23:7: “And he brake down the houses of the sodomites, that were by the house of the LORD, where the women wove hangings for the grove.”
      10. Romans 1:26: “For this cause God gave them up unto vile affections: for even their women did change the natural use into that which is against nature. 27: And likewise also the men, leaving the natural use of the woman, burned in their lust one toward another; men with men working that which is unseemly, and receiving in themselves that recompense of their error which was meet.”
      11. 1 Corinthian 6:9: “Know ye not that the unrighteous shall not inherit the kingdom of God? Be not deceived: neither fornicators, nor idolaters, nor adulterers, nor effeminate, nor abusers of themselves with mankind.”
      12. 1 Timothy 1:9: “Knowing this, that the law is not made for a righteous man, but for the lawless and disobedient, for the ungodly and for sinners, for unholy and profane, for murderers of fathers and murderers of mothers, for manslayers. 10: For whoremongers, for them that defile themselves with mankind, for menstealers, for liars, for perjured persons, and if there be any other thing that is contrary to sound doctrine;”
      13. Psalms and The Song of Solomon.
      14. The book of Ruth.

  8. Well, let’s see now - one can burn the American Flag (which I do not agree with) as “free speach” , but this guy gets 16 years in jail for tearing down a gay flag on a church and burning it. These judges are pathetic.
