Hillary Clinton said Friday that the true test posed by the impeachment inquiry of President Donald Trump is whether the Republican-controlled Senate “will affirm that an American president is not above the law.”
“The question is not whether Trump has committed impeachable crimes,” the 2016 Democratic presidential nominee said on Twitter. “He has.
“The question is whether Republicans in Congress will affirm that an American president is not above the law,” she said.
The House Intelligence Committee ended its public hearings for the week on Thursday and could soon hand off the probe to the House Judiciary Committee.
Any articles of impeachment approved by the House would be sent to the Senate for adjudication.
President Trump said Friday that he wants a Senate trial, telling Fox News that there “was no due process” in the House proceedings.
“You can’t have lawyers,” he said. “We couldn’t have any witness. We wanted to call the whistleblower.
“I want to see Adam Schiff testify about the whistleblower, who is a fake whistleblower,” Trump added, referring to the Intelligence Committee’s chairman.
In a Senate trial, experts say that President Trump would have the right to defend himself, though his right to confront the whistleblower is not guaranteed.
U.S. Supreme Court Chief Justice John Roberts would preside over any trial — and the Senate must determine whether Trump committed “treason, bribery, or other high crimes and misdemeanors,” as outlined by the Constitution.
