Former Counsel May Have Saved Trump From Himself

Don McGahn was barely on speaking terms with President Donald Trump when he left the White House last fall. But special counsel Robert Mueller’s report reveals the president may owe his former top lawyer a debt of gratitude.

McGahn, who sat with Mueller for about 30 hours of interviews, emerged as a central character in Mueller’s painstaking investigation into whether Trump obstructed justice and impeded the years-long Russia investigation. In one striking scene , Mueller recounts how Trump called McGahn twice at home and directed him to set Mueller’s firing in motion. McGahn recoiled and threatened to resign instead.

Mueller concluded that McGahn and others effectively halted Trump’s efforts to influence the investigation, prompting some White House officials and outside observers to call him an unsung hero in the effort to protect the president.

John Marston, a former Washington, D.C. assistant United States attorney, said McGahn appeared to help Trump “both in real time with his actions and then as well as being forthcoming.”

McGahn’s relationship with the president was turbulent. A prominent Washington attorney, he joined Trump’s campaign as counsel in 2015 and followed him to the White House, but the two men never developed a close rapport. His departure last fall came as little surprise.

Still, it was McGahn who Trump turned to on June 17, 2017, when he wanted to oust Mueller. According to the special counsel report, McGahn responded to the president’s request by calling his personal lawyer and his chief of staff, driving to the White House, packing up his belongings and preparing to submit his letter of resignation. He told then-White House Chief of Staff Reince Priebus that the president had asked him to “do crazy s—.”

Mueller said McGahn feared Trump was setting in motion a series of events “akin to the Saturday Night Massacre,” the Nixonian effort to rein in the Watergate investigation.

William Alden McDaniel, a lawyer who represented targets and witnesses in the Ken Starr investigation, as well a high-ranking officials in the Iran-Contra scandal, said McGahn appeared to be “one of the few people in the administration to stand up to the president” and that “takes a certain amount of principle.”

Mueller’s report shows there were a handful of other aides who rebuffed orders and suggestions from the president, helping save him from the consequences. Former campaign manager Corey Lewandowski resisted an effort by Trump to convince Attorney General Jeff Sessions to un-recuse himself from the investigation and to limit the scope of Mueller’s probe. Priebus and McGahn repeatedly resisted Trump efforts to force out Sessions so that Trump could replace him and install a new person to oversee Mueller’s work.

McGahn also tried in other ways to keep the president in line, advising him that he should not communicate directly with the Department of Justice to avoid the perception or reality of political interference in law enforcement and reminding him that their conversations were not protected by attorney-client privilege.

Trump responded by questioning McGahn’s tendency to take notes and draft memoranda outlining his advice to the president for the historical record.

“Why do you take notes? Lawyers don’t take notes. I never had a lawyer who took notes,” Trump said, according to Mueller’s report. The special counsel said McGahn responded that he keeps notes “because he is a ‘real lawyer’ and explained that notes create a record and are not a bad thing.”

Exchanges like those appear to have led Mueller to conclude that McGahn was “a credible witness with no motive to lie or exaggerate given the position he held in the White House.”

McGahn did not respond to a request for comment Thursday and nearly a dozen friends and former colleagues mostly spoke on the condition of anonymity to avoid upsetting him, describing him as a private person.

They largely characterized McGahn’s time in the White House as unhappy and defined by his frequent clashes with the president.

“Don is an experienced lawyer who’s dealt with difficult clients in the past,” said Jason Torchinsky, an election law attorney who has known McGhan for 20 years.

The White House declined comment.

In a campaign and White House staffed largely by novices and bootlickers, McGahn was a rare establishment figure, despite his longer hair and 80s cover band dabbling. He served as commissioner and chairman of the Federal Election Commission and had deep roots with the Republican party, including spending a decade as general counsel of the National Republican Congressional Committee.

At the White House, he earned praise from conservatives for helping confirm a series of conservative judges, including, in his final act, shepherding Supreme Court nominee Brett Kavanaugh’s confirmation. He was also instrumental in fulfilling long-held conservative priorities, including leading the White House’s systematic effort to cut government regulations and weaken the power of administrative law judges.

  1. As a lawyer is remember Lincoln’s words that a lawyer’s time and advice are his stock in trade. To keep the President from making mistakes of the kind reported was why he was being paid. Advice and counsel is deeply embedded in our constitutional republic. Perhaps it is laudable that the President took that advice and counsel.

    As for Mueller, I would have fired his ass as soon as I learned what sort of Democrat rogue’s gallery he had assembled as his investigative team or given him the option of cleaning out the stalls and hiring a more balanced team so it would avoid the appearance of bias and partisanship.

I don’t know how trump refrained from firing Comey for as long as he did and getting rid of Muller because it was clear from the start that there would be no justice served by Muller and his political hacks and if there was anything that these democrat group of flunkies could pin on trump they were out to get him . trump can not satisfy the democrats and bias news media no matter what path he takes, he should have said he was for raising taxes, open boarders , more crime and the green new deal and trump could have sat back and watch the democrats scurrying around like little mice to oppose all of that so in reality they would be passing all of trump’s agenda without him even lifting a finger because the democrats would have just done the opposite of what trump wanted

  4. Everyone will be cast as heroic except for President Trump who was the target of an investigation that was rooted in corruption at the FBI, DOJ, CIA and the Obama Administration! In the final analysis, Trump was able to weather all the attacks and rise unscathed to carry on his work as POTUS!

Don’t forget President Trump had some people that he trusted at the time, telling him he could and should fire Mueller. That in and of its self may have been a trap that the RINO’s and never Trumpers were trying to set to ensnare him.

What the author of this article fails to report is that Trump was within his legal and presidential rights to terminate the entire investigation and initiate an investigation of actual Russian interference in the election that was impartial an bipartisan. Nixon’s cronies and himself actually violated the law compounding the thefts with the coverup.

    Trump did not break any laws and it was Rosenstein’s advice to fire Comey. As many legal analysts have pointed out the fabricated evidence to try to ensnare Trump and his campaign violated the law. Ghans advice to Trump perpetuated a 2 year fraudulent investgation. If Trump had fired Mueller straight out and directed Sessions to appoint a truly impartial counsel and team then this would have ended within a few months. Which, as many analysts have pointed out, Mueller was aware of from the FBI investigation early on, there was no collusion by the President with the Russians. Both Sessions and Mueller are corrupt Rinos who hate Trump. He would have been better off appointing Guiliani as AG, and this mess would be a distant memory by now.

  12. What I find funny is how the mainstream media keeps trying to accuse Trump of collusion and obstruction via the Mueller report. Presidents are human beings as well, and are subject to bad thoughts. A simple example is, I want to punch Mueller in the face. Sure, might feel good, but you can’t do that because you’ll be charged, etc, etc. Now what he “could” be charged with is not so evident up front when you’re talking obstruction, because I’m sure his first thoughts were not about obstruction but about the overwhelming biased team assembled against him, and how idiotic Democrats and the liberals have been attacking him non-stop from the beginning. There was not one unbiased, or at least someone fighting in his corner on that team at all. It was designed solely for witch hunt purposes. How would you feel with a team like that investigating your life, and every single action or thing you said put under a microscope? Trump is a businessman, not a politician, so his thought process is not one of a political planner, but one of, how do I get this done. THAT is one of the reasons why there is no collusion or obstruction. Because he listened to counsel even though it might have pissed him off, or he might not have agreed with it. In the end, he did what was right. Of course, from the Democrats perspective, they are after him just for thinking about doing some things, which he never did. Focused on what he said verses what he did. Of course, they want to interpret Comey’s firing as obstruction, when Comey was one of the ones that allowed the fake dossier to be used in so much of their illicit actions against Trump!! I love how the MSM never addresses none of the actual relevant stuff, nor about how he’s doing an awesome job trying to protect the citizens of this country, while the Democrats implode and are trying to take the country with them.   13. Exactly. It didn’t yield the results they were expecting so now the investigator is being investigated, and they’re opening new investigations so they can try to nail Trump on something! Until they finally come back with something, or convince a majority of people in Congress to impeach him, they’re going to keep going like an evil energizer bunny until he’s out, or they’re beaten. Even then, notice how they always are going plain evil themselves, there’s no telling how far they’ll swing, and simply end up committing atrocities. They’ve shown that there is no level too low for them to stoop. Just when you think they couldn’t stoop any lower, they reach a new low. They can’t tell the truth to save themselves, they’re lockstep arm in arm with the mainstream media. The frenzy with which they continue to drive themselves into is maddening. Remember when Scalise was shot at softball practice and how the fact that a Democrat injured those Republicans was quickly and quietly just swept under the rug, and they basically implied that Republicans kinda deserved it?
