DOJ Ordered To Preserve Comey Email Records


The Department of Justice has been ordered by a federal court to preserve federal records from the personal email accounts of former FBI Director James Comey, following a joint motion by the Daily Caller and Judicial Watch to compel the preservation.

In the motion, Judicial Watch argued that “there is reason to be concerned that the responsive records could be lost or destroyed.” Judicial Watch pointed out that in June 2018, the DOJ’s Inspector General stated, “We identified numerous instances in which Comey used a personal email account (a Gmail account) to conduct FBI business.” The Justice Department, in response to Judicial Watch’s concerns, sent Mr. Comey a letter asking him to preserve records but refused to make the letter available and opposed a preservation order.

In granting the motion for a preservation order, the court ruled:

[T]he Court will allow [the DOJ] until September 28, 2018 to complete its review and release of any responsive, non-exempt records to Plaintiffs. That being said, [the DOJ] is also ORDERED to make rolling productions between today and September 28, 2018, at reasonable intervals, of any records that are reviewed and found to be responsive and non-exempt.


In order to avoid any possible issues later in this litigation, the Court will GRANT [Judicial Watch’s] Motion. [The DOJ] is ORDERED to take all necessary and reasonable steps to ensure that any records that are potentially responsive to either of the Plaintiffs’ FOIA requests located on former Director Comey’s personal e-mail account are preserved. Although it contends that such an order is unnecessary, [the DOJ] has not explained why this preservation order would prejudice Defendant or cause any undue burden.

In her ruling, Judge Colleen Kollar-Kotelly made clear: “This Order should not be interpreted in any way as indicating that the Court has taken any position as to whether the former Director’s e-mail account will contain any responsive records. It also should not be interpreted in any way as expressing any concern on the Court’s behalf that Defendant or Director Comey would lose or purposefully destroy responsive records.”

The Court is issuing this preservation order simply because it does not appear to burden Defendant, and it will limit the possibility that the retention of these records, should they exist, might create a dispute at a later stage of this case -Judge Colleen Kollar-Kotelly

On Monday, the Daily Caller  reported:

“The Daily Caller News Foundation is suing the Department of Justice for failing to produce records regarding the Columbia University professor who received four memos from former FBI Director James Comey, one of which was leaked to The New York Times.

Cause of Action Institute, a conservative nonprofit watchdog, filed the lawsuit on behalf of TheDCNF Monday after the Justice Department and the FBI failed to produce any records related to Daniel Richman in response to the news organization’s April 25 Freedom of Information Act request.”

TheDCNF seeks all of Mr. Richman’s work product developed on behalf of the former FBI director. It also seeks “all communications between the bureau and Mr. Richman concerning his SGE work assignments, all intra-bureau communications about Mr. Richman and his assignments and activities, as well as all work product delivered to Director Comey or to others within the bureau.” –Daily Caller 

Perhaps we will finally get some answers on the full extent of Richman’s activities?


  1. Comey is as crooked as a sidewinder rattlesnake and hopefully, face justice for all the crimes he has committed. I have faith he will face God’s justice in the end.

    • It’s a given that Comey and everyone else will face God’s judgement. I just hope Comey faces American justice before he faces God.

    • If it weren’t for President Obama we might not have done the intelligence community assessment that we did that set up a whole sequence of events which are still unfolding today including Special Counsel Mueller’s investigation. President Obama is responsible for that. It was he who tasked us to do that intelligence community assessment in the first place. CLAPPER’S OWN CONFESSION

  2. This is both scary and very dangerous. IF Hillary would have been voted in as president, where were we all headed. They(the left) had no idea that Trump would win. They were sloppy. Comey is a very dirty cop that had unimaginable power. The FBI is ruined for ever as far as trust goes. The people will never be fooled again. It will take a miracle to restore any trust towards the FBI. All of the top agents from the head down need to resign and be deeply investigated. If you are a republican, you better get out and vote. I cant imagine the world that Hillary, and scum like Comey, had planned for all of us walmart smelling, deplorable, stupid, low class morons, that voted for our president Trump. Scarry, very very scary. VOTE VOTE VOTE. Do you realize that less than 18% of the people vote in every election. Your vote counts. One less for them, and one more for your pick.

  3. Regardless of the order, I would be surprised if all the records still exist. The FBI/DOJ has been steadfast in covering up their incompetence and their political bias throughout this entire scandal in order to protect their own, and I don’t expect that to change. If they can stonewall this long enough, they depend on it all going away. Should the Democrats take control of either branch of Congress in November it will happen. If not, then the stonewalling will continue until 2020 hoping for a change in administrations or Congress.

  4. What are agencies’ and agency employees’ recordkeeping responsibilities when the use of personal email accounts is authorized?
    While agency employees should not generally use personal email accounts to conduct official agency business, there may be times when agencies authorize the use of personal email accounts, such as in emergency situations when Federal accounts are not accessible or when an employee is initially contacted through a personal account. In these situations, agency employees must ensure that all Federal records sent or received on personal email systems are captured and managed in accordance with agency recordkeeping practices. Agency policies and procedures must also ensure compliance with other statutes and obligations, such as FOIA and discovery.

  5. I really hope, but not holding my breath, that the wheels are justice are beginning to turn in the right direction!!
    Can you believe this Comey Criminal implies H.W. might run for Pres.? OMGOSH, we may be deplorable but he is delusional!! I can see how he thought he might get by with that tho… I mean, look at how he got away with a fake friend investigation with HRC, how he leaked info to a prof friend he put on the FBI payroll, the list goes on & on. So yeah, he would be delusional enough to tout his run for the Presidency. He and Hellary can me running mates OR cell mates!

  6. Wouldn’t Comey have smashed his hard drive the way Hillary did? What are the chances that anything incriminating will be released? Zero to NONE.

  7. It’s a shame that President Trump’s DOJ isn’t more forthcoming with information which may implicate illegal activities during the Obama years and since. AG Sessions is really a disappointment from that standpoint. He is virtually absent and not very aggressive in carrying out his oath of office. That is the problem with rewarding political supporters with jobs like that, rather than selecting the best persons for the position.

  8. They will just turn everything over to Hillary Clinton-BY BY ALL EVIDENCE-and no one will be charged with destroying evidence
